CAMP BAND™ Musician Participation Agreement

Before joining CAMP BAND™, participating musicians must read and agree to the following expectations and terms:

1. Sponsor recognition. I will honor my professional obligation to give positive, respectful recognition to up to six show sponsors throughout the performance as directed by CAMP BAND™ and consistent with the sponsorship level for that show.
2. Professional performance. I will arrive on time, prepared to perform, and will play for the agreed-upon performance time, typically approximately two hours unless otherwise arranged.
3. Social-media support. I understand that, although not mandatory, I am strongly encouraged to announce and/or display supporting sponsor logos when promoting CAMP BAND™ shows on social media.
4. Sponsor attendance and expectations. I understand that sponsors, their employees, friends and families may attend CAMP BAND™ shows and will reasonably expect to hear the recognition associated with their sponsorship.
5. Payment timing. I understand that payment for a performance may take up to two weeks. Sponsors are required to pay before each show. Venues may take up to three weeks to pay, although CAMP BAND™ encourages venues to pay within one week.
6. Tax information. I will provide the information CAMP BAND™ reasonably requires for tax-reporting purposes, including a completed W-9 when requested.
7. Helping grow CAMP BAND™. I am encouraged to share the benefits of CAMP BAND™ with venues and potential sponsors to help build support, opportunities and attendance for my shows.
8. Monthly musician membership and cancellation. I understand that CAMP BAND™ currently charges participating musicians $10.00 per month to support the platform and CAMP BAND™'s role in connecting musicians, venues and sponsors. Membership fees are billed monthly and are non-refundable once charged. I may discontinue my participation and future monthly billing at any time by sending a cancellation request to support@campband.com. Cancellation stops future recurring membership charges but does not refund fees already paid or charged. I understand that future monthly fees may change if CAMP BAND™ updates its published fee settings.
9. Dispute resolution / binding arbitration. To the extent permitted by applicable law, CAMP BAND™ and I mutually agree that disputes, claims or controversies arising out of or relating to my participation in CAMP BAND™ or services provided through CAMP BAND™ will be resolved through binding arbitration rather than a lawsuit in court. The arbitration will take place in Santa Barbara County, California, before a neutral arbitrator. If the parties cannot agree on an arbitrator, the arbitrator will be selected under applicable California arbitration procedures. This provision applies equally to CAMP BAND™ and me. It does not waive rights or remedies that cannot legally be waived, and it does not prevent either party from using small claims court when a claim is eligible to be heard there.
10. Musician conduct and responsibility. I understand that CAMP BAND™ provides a platform and administrative service that helps connect musicians, venues and sponsors. I remain responsible for my own conduct, performance, equipment, transportation, actions, omissions and compliance with applicable laws. To the fullest extent permitted by law, CAMP BAND™ is not responsible for the independent acts, omissions, misconduct, negligence or behavior of participating musicians.
11. CAMP BAND™ platform / administrative fee. I understand and agree that CAMP BAND™ retains a 10% platform and administrative fee from amounts CAMP BAND™ collects from participating sponsors and venues in connection with my CAMP BAND™ performances. CAMP BAND™ retains this fee before distributing the remaining applicable performance funds to the participating musician.
12. Tips belong to the musician. I understand that 100% of tips given to me in connection with a performance are mine to retain. CAMP BAND™ does not deduct its platform or administrative fee from musician tips.
13. Participation, suspension and no income guarantee. I understand that participation in CAMP BAND™ is a privilege and does not create a guarantee of continued participation. To the extent permitted by law, CAMP BAND™ may decline, suspend, deactivate or discontinue my participation at any time, including for failure to follow these participation terms, unprofessional conduct, complaints from venues or sponsors, nonpayment of applicable fees, conduct that may harm CAMP BAND™ or its participants, or other legitimate business or community reasons determined by CAMP BAND™. CAMP BAND™ does not guarantee any minimum number of performances, bookings, sponsorships, compensation, audience size or income. Opportunities and earnings may vary based on venue demand, sponsor participation, availability, location, audience interest and other circumstances.
